46.《福建省非物质文化遗产条例》规定，代表性传承人或者保护单位存在哪些情形，会由原认定部门取消其代表性传承人或者保护单位资格？

答：省人民政府文化主管部门应当建立代表性项目保护情况评估制度。县级以上地方人民政府文化主管部门应当定期对本级代表性项目的保护情况进行评估，并向社会公开评估结果。

经评估，代表性传承人或者保护单位存在下列情形之一的，由原认定部门取消其代表性传承人或者保护单位资格，并向社会公布：

（一）无正当理由不履行传承义务的；

（二）因保护不力、保护措施不当或者违反合理利用原则，导致项目存续状况恶化或者失去真实性的；

（三）违反法律法规规定造成恶劣影响的。

代表性传承人死亡或者丧失传承能力的，由原认定部门终止其代表性传承人资格，并向社会公布。

Q46. According to the Regulations on Intangible Cultural Heritage in Fujian, under which circumstances shall the qualifications of representative inheritor(s) or protection units be revoked by competent approval authorities?

Answer: The department in charge of culture under the provincial people’s government shall establish an evaluation system for the protection of representative item of intangible cultural heritage. The department in charge of culture under the county-level people’s government shall evaluate the protection of representative item of intangible cultural heritage at equivalent level and release the result to the public. Where any one of the following circumstances occurs, the qualifications of representative inheritor(s) or protection units shall be revoked by competent approval authorities:

(a) Failure to perform the obligations prescribed without legitimate grounds;

(b) The representative item of intangible cultural heritage being at a deteriorated survival status or losing authenticity due to poor protection measures or violation of reasonable use principle;

 (c) Causing bad implications due to violation of laws or regulations.

Where the representative inheritor is deceased or loses inheritance ability, the competent authority may terminate the representative inheritor’s qualification and reports to the public.
