50.违反《福建省非物质文化遗产条例》规定，在申报代表性项目、代表性传承人过程中弄虚作假的该如何处理？

答：应由县级以上地方人民政府文化主管部门取消其参评资格。对已经列入代表性项目名录或者已经取得代表性传承人资格的，由原认定的文化主管部门予以撤销，责令返还已经取得的项目保护经费或者传承补贴，处 1000元以上 5000元以下罚款。有违法所得的，没收违法所得。

Q50. How to deal with the fraud in application for representative items or inheritors of intangible cultural heritage?

Answer: The applicant’s qualification shall be canceled by the department in charge of culture under the people’s government at county-level or above. Where representative items or inheritors of intangible cultural heritage have been granted, such qualifications shall be revoked by competent authority in charge of culture, and item protection funding or inheritance subsidies shall also be returned. Additionally, a fine in the amount of 1,000 to 5,000 yuan shall also be imposed, and illegal proceeds, if any, shall be confiscated.
